Swish N+1 T&Cs

These terms and conditions have been written as far as possible without any legalese, and to keep things as straight forward as possible.

If you would like us to make anything more clear, let us know and we’ll adjust them to make it so.

Terms and Conditions Of N+1 Membership:

  1. Background:

    1. The over-riding goal of Membership is to enable Members and ourselves to work together to make great bikes more accessible to more people
    2. This Membership is most suitable for cyclists who like to ride lots of different types of bikes, and/or would like to ride many different brands of a specific type of bike
    3. By signing the Agreement, you are committing to becoming a Swish N+1 Member of Swish Cycles
  2. Additional Membership Benefits:

    1. Swish N+1 Members will automatically benefit from:
      1. 25% discounts on the RRP of all Accessories, and
      2. 15% discounts on the RRP of all Components
      3. This is subject to availability
    2. Additional Membership benefits will be communicated to you from time to time e.g. riding trips, factory visits, special offers etc
  3. How The Payments Work:

    1. The initial payment is used as security for the bikes you use during the period of your Membership.  If you choose to leave at any time you can use these funds towards the cost of any new or second hand bike that we have on offer.  They are not refundable
    2. The weekly payments you make determine the value of the bikes that you can choose from
    3. There are currently 4 levels of weekly payment:
      1. £10/wk gives you access to bikes worth up to £1,500
      2. £25/wk gives you access to bikes worth up to £2,500
      3. £35/wk gives you access to bikes worth up to £3,500
      4. £52.50/wk gives you access to bikes worth up to £5,500
    4. You are responsible for paying the courier fees for sending bikes to you, we are responsible for paying for the bikes to be collected
  4. Upgrading or Downgrading:

    1. You can upgrade to more valuable bikes by increasing your weekly payments and paying any difference in the initial payment
    2. You can downgrade to less valuable bikes but any variances in the initial payment amounts will not be refunded
    3. You’ll need to contact us directly to make any amendments to your Membership
  5. Deciding You’d Rather Own A Bike:

    1. We recognise that whilst your riding lots of different bikes you may well find one that is perfect for you and you’d like to keep it.  N+1 Membership accommodates that
    2. If you decide that you’d like to keep one of the bikes permanently you can use all your payments from the last 52 chronological weeks of payments towards paying for the RRP of the bike
    3. You are able to continue your N+1 Membership as well by continuing your weekly payments with a small weekly uplift equal to the initial payment divided by 52 for the consecutive 52 weekly payments
  6. Cancellation:

    1. You can cancel at any time by giving us 2 months notice and making arrangements for the bike to be returned to us
    2. If you cancel within 6 months of your Membership commencing, you can use your initial payment towards making a purchase from us
    3. If you cancel after 6 months, you can use any funds paid, up to a maximum of the last 12 chronological months of payments, towards a new bike.  In other words, if you cancel in month 12, your initial payment will be included, if you cancel in month 13 and beyond, it will not
    4. We reserve the right to cancel Membership for any individuals who abuse the bikes, other Members, or ourselves
  7. Choosing A Bike:

    1. Contact us and let us know which bike you would like.  We’ll give you an ETA for it.  We’ll always endeavour to have it available for you when you want it
    2. We make all the courier arrangements for the movement of bikes
    3. If the bike you want to change to is not immediately available, an alternative of similar value will be offered, until the bike you want comes into stock
  8. Getting The Bike:

    1. The bike will be delivered to you via our couriers
    2. The couriers will inform you of a delivery window
    3. The bike will arrive with you fully assembled, except for the possibility of your needing to attach the handlebars and front wheel
    4. A mechanic will always be available to assist you should you need it.  There may be a small charge for this
    5. Please keep any packaging so that you can return a bike to us
    6. We’ll usually arrange for you to return a bike at the same time that you collect a bike, unless you specifically request to keep one for a little longer and it is not needed by any other Member at that point in time
  9. Changing Bikes:

    1. If you have possession of a bike that another Member wishes to try, we’ll initially invite you to swap for another bike and discuss a replacement with you
    2. If you do not wish to swap, then we shall endeavour to accommodate you.  We would only ask you to swap if you’ve had use of a specific bike for around 2 months
    3. You are responsible for paying for courier costs for a bike being delivered to you
    4. We are responsible for payment for courier costs for a bike being collected from you
  10. Included and Excluded Bikes:

    1. All types of bikes are included in this offer.  However, for transparency purposes, we shall actively limit the number of downhill, freeride, BMX, Trials and Jump bikes available as they are frequenctly “trashed” by the nature of the type of riding they are subjected to, and, as you remain responsible for any damage, it makes sense that these types of bikes are avoided if possible
    2. That being said, we want our Members to be able to experience any type of bike so we shall accommodate your wishes, it just may take a little longer to source a bike for you due to the limited number we shall make available
    3. We shall always avoid brands that have historically not come up to our high standards of after care and warranty support.  This enables us to focus upon brands that will assist you should any warranty issues occur, rather than expect you to pay for any warranty related failures
  11. Ownership Of The Bike:

    1. The bike remains our property at all times
    2. You are not automatically entitled to keep a specific model of bike indefinitely, but we shall always try to accommodate your wishes
    3. We reserve the right to request the return of the bike at any time
  12. International Members

    1. This option is designed to accommodate UK Members generally, but we can accommodate International Members as well
    2. International Members will be required to pay for courier costs for the collection and return of the bikes
    3. We may also require a holding deposit on some bikes
  13. Missed Payments:

    1. If you miss a payment, we’ll remind you
    2. If you miss 2 payments we reserve the right to request the return of the bike(s) until you have paid these missing payments
    3. Further missed payments may result in our cancelling your Membership without recourse and without prejudicing our ongoing ownership of the bikes, whcih shall at all times remain our property
  14. Looking After The Bike (Damages, Breakages & Faults)

    1. You’re required to keep the bike you currently have use of in excellent condition and to report any damage to us promptly so that we can find a solution
    2. Any component repairs will be completed at cost, not retail
    3. Any frame repairs will either be covered by insurance or carried out by our frame repair partners; you will be liable for any excesses (max £200) or frame repair costs
    4. Please always have consideration for the next person who may wish to make use of the bike you are using
    5. If you receive faulty goods, we shall make every reasonable effort to remedy it
    6. We’ll always endeavour to make a replacement available to you whilst a bike is being repaired due to a fault
    7. You remain liable for loss of the bike whilst it’s in your possession.  We can arrange for a very cost effective insurance policy to be in place if your household insurance will not cover the cost of the bike’s replacement.  We recommend that you inform your insurance company each time you change your bike.  If they require paperwork from us then please ask them to communicate with us via email: info@swishcycles.co.uk or post Unit B1f, Fairoaks Airport, Chertsey Road, Chobham, Surrey, GU24 8HU
  15. General:

    1. You’ll need to inform us of any change of address or employment circumstances that reduce your household’s income
    2. This Membership model is probably not suitable for you if you wish to own a single model of bike; we’ve other options available to you
    3. Membership is ongoing unless you give us 2 months notice of your desire to cancel
    4. These Terms and Conditions are designed to enable us all to work cooperatively and have a clear understanding of our position at all time.  We shall always endeavour to have common sense prevail and encourage our Members to do the same
    5. We’ll need photo ID, proof of address and proof of income from you in order to become a Member
